International Trade: USMCA Receives Congressional Approval, Awaits President’s Signature
On January 16, 2020, the U.S. Congress completed the statutory approval process for the United States-Mexico-Canada Agreement (USMCA).  It now awaits the formal application of the President’s signature, which has yet to be scheduled.  Pursuant to the Bipartisan Congressional Trade Priorities and Accountability Act of 2015, 19 U.S.C. 4201 et seq., (generally referred to as “Trade Promotion Authority” or “TPA”), Congress granted approval through passage of HR 5430, titled the United States-Mexico-Canada Agreement Implementation Act.  HR 5430 was introduced on December 13, 2019, passed the U.S. House by a 385-41 vote on December 19, 2019 and passed the U.S. Senate by a 89-10 vote on January 16, 2020.  USMCA has already been fully ratified by the Mexican government but still must be approved by the Canadian Parliament before implementation.  The congressional approval process was triggered by the December 10, 2019, announcement by the Office of the United States Trade Representative (USTR) that the United States, Mexico, and Canada had reached a final agreement on amendments and implementation details of the previously-negotiated USMCA dated November 30, 2018.  The completed USMCA terminates and replaces the North American Free Trade Agreement (NAFTA).  The final USMCA text is available on the USTR website, along with various fact sheets providing details.  One fact sheet is titled “Agriculture: Market Access and Dairy Outcomes of the USMC Agreement” and another addresses the USMCA’s impact on Pennsylvania

Farm Bill: Fourteen States, New York City, and District of Columbia Sue USDA Over SNAP Benefit Rule Changes 
On January 16, 2020,  Fourteen (14) states, the City of New York, and the District of Columbia, sued USDA in the United States District Court for the District of Columbia, Case 1:20-cv-00119, alleging that the December 4, 2019, Final Rule changing the conditions under which states may request and obtain a waiver of the maximum eligibility time for certain Supplemental Nutrition Assistance Program (SNAP) recipients violates the federal Administrative Procedure Act, 5 U.S.C. 701-706.  The plaintiffs are requesting that the rule be stayed, enjoined from becoming effective, vacated, and set aside.  In addition to California and New York, Pennsylvania, New Jersey, Maryland and Virginia have joined in the suit, each state alleging individualized economic harm.  Pennsylvania alleges that the Final Rule will cost it more than $2.2 million annually in increased administrative costs and will increase job-training programming costs more than $21 million over the next six years.  For more on USDA’s Final Rule changing SNAP benefit rules, see the Agricultural Law Weekly Review of December 12, 2019, titled Farm Bill: USDA Changes SNAP Benefit.

Dairy Policy: Cornell University Conducting Dairy Farmer Pricing Survey 
On January 14, 2020, Cornell University’s School of Applied Economics & Management researchers Dr. Todd M. Schmit and Roberta M. Severson commenced a confidential on-line Dairy Farmer Pricing Survey, in which a dairy producer may participate until February 15, 2020. The survey is located at https://tinyurl.com/DairyPriceSurvey.  According to the researchers, the survey is “developed to better understand farmers’ willingness to accept alternative premium programs, related milk premium adjustments, and milk handler business structures.”  The survey is intended to gather nationwide information regardless of the geographic location because the “focus is on price adjustments made by the handler after the required minimum price is determined by the relevant milk marketing order.”  Data collected “will be used to determine preferred premium structures under a range of market conditions . . . as valuable guidance to dairy farmers and milk handlers when considering alternative pricing structures beyond the milk marketing order and the expected results therefrom.”  The survey is limited to current dairy farmers and should be completed by the primary owner/operator in charge of the milk production portion of the farm business. Only one survey should be completed per farm. The survey should take approximately 15-20 minutes to complete. 

Food Policy: USDA Announces School Lunch & Summer Meals Reforms
On January 17, 2020, USDA’s Food and Nutrition Service announced the issuance of a proposed rule amending regulations governing the National School Lunch Program (NSLP) and School Breakfast Program (SBP).   The proposed rule proposes various and multiple changes to simplify meal pattern and monitoring requirements. According to the proposed rule, “implementation of the wide range of proposed changes and flexibilities is expected to simplify operational requirements, increase efficiency, and make it easier for State and local Program operators to feed children.” The proposed rule is scheduled to be published in the Federal Register on January 23, 2020, and publication will commence a sixty (60) day comment period. 

Industrial Hemp: Ohio’s Hemp Cultivation Regulations Approved by State Regulation Review Agency
On January 16, 2020, the Ohio Department of Agriculture’s hemp cultivation licensing regulations, Ohio Administrative Code 901:14-1-01 through 901:14-2-99, were approved by Ohio’s Joint Committee On Agency Rule Review (JCARR), the state government entity charged with determining if proposed agency regulations exceed the statutory authority granted by the Ohio General Assembly.  The regulations are scheduled to become effective January 31, 2020.  This action follows USDA’s December 27, 2019, approval of the Ohio Department of Agriculture State Hemp Production Plan, as required by the 2018 Farm Bill.  Ohio was one of the first three state hemp production plans approved by USDA.

Dairy Policy: PMMB Enters Order Mandating Cooperative Costs Recovery
On December 4, 2019, the Pennsylvania Milk Marketing Board (PMMB) entered an order, titled “Interim Order Regarding Cooperative Milk Procurement Costs Hearing,” (Interim Order) mandating that, from January 1, 2020, through December 31, 2020, milk dealers pay $.20 per hundredweight as part of the producer price paid to dairy cooperative members for milk produced, processed and sold in Pennsylvania as reimbursement for cooperative services such as field, laboratory and calibration services, producer payroll, sales invoicing, and dispatch and logistics.  The Interim Order resulted from a compromise agreement reached in PMMB legal proceedings, and is entered without prejudice to the positions of the parties, between the Pennsylvania Association of Dairy Cooperatives and the Pennsylvania Association of Milk Dealers.  The compromise was reached in order to determine if a scheduled July 2020 resumption, and December 2020 conclusion, of the legal proceedings can be avoided.  The justification for the payment is that a milk dealer bears the cost of those services if purchasing milk from an independent producer and recovers that cost in the Pennsylvania minimum wholesale price paid by retailers for packaged fluid milk.  However, a cooperative bears the expense for those services when a milk dealer purchases milk from a cooperative with no reimbursement, until now, in the Pennsylvania producer price paid by milk dealers.  

Farm Bill: USDA Extends Deadlines for Dairy Margin Coverage and Market Facilitation Program to December 20
On December 11, 2019, USDA announced that the deadline for dairy producers to enroll in the Dairy Margin Coverage (DMC) program has been extended from December 13, 2019, to December 20, 2019.  The 2018 Farm Bill authorized the DMC Program to provide payment to dairy producers when the margin between the all-milk price and the average feed cost falls below a certain dollar amount selected by the producer at enrollment.  USDA also announced that it would continue accepting applications from all eligible commodity producers for the Market Facilitation Program through December 20, despite the original closing date of December 6, 2019.  MFP is part of the 2018 and 2019 Trump Administration Trade Aid packages and provides payment to producers of certain commodities as compensation for decreased exports according to parameters developed by USDA.  The MFP application is filed at a producer’s local Farm Services Agency (FSA) office, as is a DMC Program enrollment.

Farm Bill: USDA Changes SNAP Benefit
On December 4, 2019, USDA announced it would publish in the Federal Register a Final Rule (84 FR 66782), finalizing a February 1, 2019, proposed regulation amendment (made primarily effective April 1, 2020) changing the conditions under which states may request and obtain a waiver of the maximum eligibility time for certain Supplemental Nutrition Assistance Program (SNAP) recipients.  “Three months in a three-year period” is the time limit for able-bodied adults between ages 18 and 49 without dependents (ABAWDs) to collect Supplemental Nutrition Assistance Program (SNAP) benefits without working or participating in work training for at least 20 hours a week.  Waivers of that time limit are available in areas having over 10% unemployment or in which there is a lack of sufficient jobs.  The amendments restrict the scope and number of waivers that can be granted, as compared to current practice, by redefining: (a) the determination of the area of a waiver; (b) whether there is a lack of sufficient jobs; (c) the calculation of the required unemployment rate; and also by limiting the practice of states carrying forward a balance of unused annual waiver requests from one federal fiscal year to the next.   

International Trade: USMCA Signed by United States, Mexico and Canada
On December 10, 2019, the Office of the United States Trade Representative announced that the United States, Mexico, and Canada reached an agreement to amend the United States-Mexico-Canada Agreement (USMCA), a renegotiation of the North American Free Trade Agreement (NAFTA) signed November 30, 2018. The text of the USMCA as signed on November 30, 2018, and an unsigned document dated December 10, 2019, titled “Protocol of Amendment,” are available on the website of the Office of the United States Trade Representative, along with a fact sheet titled “Agriculture: Dairy Outcomes of USMC Agreement.” A document identified as the document signed on December 10, 2019, has not yet been released in electronic format at this time. International Trade: Japan Approves October Trade Agreement with United States
On December 4, 2019, the Office of the United States Trade Representative announced that Japan’s Diet (equivalent to its Parliament) approved an October 2019 trade agreement with the United States, expected to be put into effect January 1, 2020, which more widely opens Japanese markets to U.S. agricultural products.  For example, it reduces tariffs on U.S. beef in stages from a current 38.5% to 9% by 2033

Agricultural Law Weekly Review—September 28, 2017

The following information is an update of recent local, state, national, and international legal developments relevant to agriculture:

GMOs: Syngenta Settles with Corn Farmers over Loss of Chinese Market
On September 26, 2017, Syngenta announced that a settlement had been reached with U.S. corn farmers “to resolve litigation concerning the launch of Syngenta’s Agrisure Viptera and Agrisure Duracade corn traits.” The litigation stemmed from allegations that Syngenta had introduced new genetic traits (commercially advertised as Viptera and Duracade) into the U.S. corn market before the genetically modified varieties had been approved by all major export markets.  Eventually, the traits were detected in U.S. corn imports to China and resulted in U.S. corn farmers being denied access to the Chinese market.  Though Syngenta did not disclose the financial terms of the settlement, Bloomberg News reported  that the total amount exceeded $1.4 billion.

Pesticides: EPA Intends to Permit Use of Dicamba in 2018
On September 20, 2017, Reuters reported that the U.S. Environmental Protection Agency (EPA) intends “to allow farmers to spray the controversial weed-killer dicamba next year, but with additional rules for its use.” According to the report, Reuben Baris, the acting chief of the herbicide branch of the EPA Office of Pesticide Programs, recently told state regulators that “the agency had not yet determined what steps it would take to mitigate problems associated with dicamba.” Reuters stated that “[t]he herbicide, which fights weeds resistant to another herbicide called glyphosate, was linked to widespread crop damage this summer.” Accordingly, some farmers have alleged that “the chemical caused damage by drifting away from where it was sprayed to fields of soybeans and other plants that could not tolerate it.”

Labor: Michigan Dairy Pleads Guilty to Hiring Undocumented Immigrants
On September 20, 2017, M Live reported that Michigan dairy farmer Denis Burke has pleaded guilty to federal charges of hiring undocumented immigrants. The report stated that “[b]etween February 2008 and May 2013, [Burke and his wife] hired and harbored more than 100 undocumented immigrants to work on their [two Michigan] farms.” According to the report, under the terms of the guilty plea, Burke faces a prison sentence of between 33 and 41 months and must pay a fine of $187,500.

SNAP: USDA Extends D-SNAP to Floridians Affected by Hurricane Irma
On September 22, 2017, the U.S. Department of Agriculture (USDA) announced that “Floridians struggling with the after effects of Hurricane Irma could be eligible for help buying food through USDA’s Disaster Supplemental Nutrition Assistance Program (D-SNAP).” According to Agriculture Secretary Sonny Perdue, “households who may not normally be eligible under regular SNAP rules may qualify for D-SNAP -- if their income is under the disaster limits and they have qualifying disaster-related expenses.” The announcement stated that “D-SNAP eligible households in the affected areas will receive two months of benefits, equivalent to the maximum amount of benefits normally issued to a SNAP household of their size.”

Antimicrobial: FDA Announces Public Meeting for National Antimicrobial Resistance Monitoring System
On September 21, 2017, the U.S. Food and Drug Administration (FDA) published notice in the Federal Register announcing a public meeting entitled 2017 Scientific Meeting of the National Antimicrobial Resistance Monitoring System (82 FR 44189).  According to the notice, “[t]he purpose of the public meeting is to discuss the current status of the National Antimicrobial Resistance Monitoring System (NARMS) and directions for the future.”  The announced meeting is scheduled to be held in Washington, DC on October 24 and 25, 2017.

Spotted Lanternfly: PDA Expands Spotted Lanternfly Quarantine
On September 22, 2017, the Pennsylvania Department of Agriculture (PDA) announced that the Commonwealth’s Spotted Lanternfly quarantine had been expanded to include 26 municipalities in Berks, Bucks, Chester, Lehigh, Montgomery and Northampton counties.  According to PDA, “[t]he quarantine was already in effect in other areas of the six counties.” PDA stated that the Spotted Lanternfly, which can be particularly destructive to the apple, grape and hardwood industries, “had not been found in the United States prior to its initial detection in Berks County in the fall of 2014.”
